3 Proposed Constitutional Amendments on the 2026 Ballot in Virginia
Question 1 - Reproductive Freedom:
Vote YES on all 3 questions:
The proposed amendment would protect a person's fundamental right to make and carry out decisions about their reproductive care, including - prenatal care and childbirth, contraception, fertility, abortion care (up to 3rd trimester), miscarriage care, and postpartum care.
Abortions in the third trimester are only allowed when it is medically needed to protect the life & health of the mother or if the fetus is not viable.

Question 3 - Voting Rights:
The proposed amendment would protect the fundamental right to vote and automatically restore voting rights to people convicted of felonies upon their release from incarceration.
The proposed amendment would remove Virginia's constitutional ban on same-sex marriage and ensure all marriages between two adults are recognized equally.
Question 2 - Marriage Equality:
In its 2015 decision, Obergefell v. Hodges, the US Supreme Court protected marriage equality. But if that decision were overruled, passage of this amendment would prevent the ban on same-sex marriage from becoming enforceable again in Virginia.
Virginia is one of only 2 states where voting rights are not automatically restored after a person has served their sentence. Currently, ex-felons in Virginia must appeal to the Governor to have their voting rights restored.
